Fines for truck overloading will increase to UAH 51,000: Zelensky signed the law

President Volodymyr Zelenskyi signed the law “On Amendments to the Code of Administrative Offenses Regarding Certain Matters of Weight Control” No. 1582-IX. This was reported by the press service of the head of state.

The law was developed with the aim of preventing the destruction of highways, improving road safety, reducing the number of road accidents, and preserving people’s lives and health.

The document provides for administrative responsibility for offenses in the field of safety on road transport, recorded with the help of photo and film photography, video recording, in particular in automatic mode.

The law also provides for fines for drivers of vehicles for failure to comply with requests to stop from representatives of the State Transport Safety Service (Ukrtransbezpeka), entering inaccurate information about the weight or dimensions of the cargo in the goods and transport invoices, etc.

Procedure of automatic calculation of fines

The weighing-in-motion complex (WIM-station) records the exceeding of the established norms and sends the information to the Data Processing Center. The inspector checks it, forms a resolution and puts an electronic signature. After that, the resolution is printed and sent to the violator. Data captured by means of photo and video recording, in particular in automatic mode, will be the basis for imposing fines.

What fines are provided for:

For exceeding the dimensions and weight standards

  • for 5-10%, the fine will amount to 500 tax-free minimum incomes of citizens (8500 hryvnias)
  • by 10-20%, the fine will increase to 1,000 minimums (17,000 UAH)
  • by 20-30% – 2,000 tax-free minimums (34,000 UAH)
  • over 30% – 3000 minimum (51,000 UAH)
  • Evading or refusing to pass weight and dimensions control, as well as exceeding the established speed limits of vehicles, violating the requirements of road signs and roadway markings, the location of vehicles on the roadway, committing offenses in the area of weight and dimensions control will result in the imposition of a fine in the amount of 3,000 tax-free minimum incomes of citizens (51,000 UAH).

    The fine for failure to comply with the demands of Ukrtransbezpeka employees to stop the vehicle in the amount of 3,000 tax-free minimums (51,000 UAH) will now be paid by the owner, not the driver of the vehicle.

    Also, a fine similar in size has been introduced for entering by the consignor inaccurate information about the weight or dimensions of the cargo in the waybill.

    Likewise, a fine of 50-150 non-taxable minimum incomes (850-2550 UAH) was established for non-fulfillment of legal requirements by officials of Ukrtransbezpeka.

  • On June 6, 2020, President Zelensky instructed the law enforcement officers to start a fight against the violation of dimensions and weight restrictions by trucks on Ukrainian roads. According to the calculations of the Ministry of Infrastructure, Ukraine spends up to 2 billion hryvnias annually on patching roads from potholes and breakdowns caused by violations of weight restrictions. On August 20, the Cabinet of Ministers allowed to carry out weight and dimensions control by one employee of Ukrtransbezpeka with the involvement of officials of the National Police, Ukravtodor and balance-keepers of GVK points.
  • On June 23, the Ministry of Infrastructure launched a program for automating the calculation of fines for violations by motor carriers of dimensions and weight norms.
